1Acceptance of Terms
By booking a safari, making a payment, or using milelekenya.com, you agree to be bound by these Terms & Conditions, our Privacy Policy, and our Safari Code of Conduct.
2Bookings & Payment
Bookings and payments are handled by RAW Africa Eco-Tours, Milele Kenya's official ground tour operator, and are subject to RAW Africa's own booking terms and conditions. Full payment terms, deposit amounts, and accepted payment methods are set out in the booking form RAW Africa provides directly to you at the time of booking — please review that document carefully before paying.
3Cancellations & Refunds
Cancellations and refunds are likewise governed by RAW Africa Eco-Tours' terms and conditions, not by Milele Kenya directly. The applicable cancellation window, refund tiers, and rescheduling policy are articulated in the RAW Africa booking form issued for your safari — refer to that document, or contact RAW Africa directly, with any cancellation questions.
4Traveler Responsibilities
Travelers are expected to follow the Safari Code of Conduct in full, including guide instructions, wildlife safety distances, and respectful engagement with local communities.
5Assumption of Risk & Release of Liability
Inherent Risks of Safari Travel. Travel to and within Kenya, and participation in a Milele Kenya safari, involves inherent risks that cannot be eliminated regardless of the care taken. By booking a safari, you acknowledge that these risks include, without limitation:
- Close proximity to wild animals and unpredictable wildlife behavior, including during game drives, walking safaris, and time spent in unfenced camps or lodges
- Travel on unpaved, remote, or rugged roads, and transport in open-sided safari vehicles
- Light aircraft or small charter flights, where used as part of an itinerary
- Water-based activities, including boat safaris and river or lake crossings
- Exposure to disease (including malaria and other insect-borne illness), extreme heat, altitude, and limited access to emergency medical care in remote areas
- Political, civil, or security conditions in Kenya or connecting countries, which can change without notice
- The acts, omissions, or negligence of third parties, including local guides, drivers, lodges, camps, charter operators, and other travelers not employed or controlled by Milele Kenya
- Equipment failure, extreme or unexpected weather, and other conditions outside Milele Kenya's control
Assumption of Risk. By booking a safari, you voluntarily assume full responsibility for these and other inherent risks of travel, and confirm that you are physically able to participate in the activities included in your itinerary. If you have a medical condition that may affect your ability to safely participate, you agree to disclose it to Milele Kenya and RAW Africa Eco-Tours prior to travel.
Release of Liability. To the fullest extent permitted by Arizona law, you release, discharge, and agree not to sue Milele Kenya, its owners, officers, employees, and agents from any and all claims, demands, or causes of action arising from ordinary negligence in connection with your safari. This release does not apply to, and Milele Kenya does not disclaim liability for, gross negligence, recklessness, or intentional misconduct.
Third-Party Operators. Ground services, guiding, transport, accommodations, and activities are provided by RAW Africa Eco-Tours and other independent third-party operators, lodges, and camps, not by Milele Kenya directly. This release is in addition to, and does not replace, any waiver or release required directly by RAW Africa Eco-Tours or other third-party operators as a condition of your booking or participation.
Indemnification. You agree to indemnify and hold Milele Kenya harmless from any claims, costs, or expenses arising from your own negligent or intentional acts during your safari.
Medical Treatment Authorization. In the event of a medical emergency during your safari where you are unable to communicate your wishes, you authorize Milele Kenya, RAW Africa Eco-Tours, and their guides to arrange emergency medical treatment and evacuation on your behalf, at your expense (or your insurer's), as they reasonably determine necessary.
Binding Effect. This assumption of risk and release is binding on you, your heirs, executors, administrators, and anyone else entitled to act on your behalf.
6Travel Insurance
All travelers must carry valid travel insurance covering, at minimum, emergency medical treatment, emergency medical evacuation, and trip cancellation, for the full duration of their safari. Proof of coverage may be requested prior to departure. Travel insurance is the traveler's own responsibility to obtain; Milele Kenya does not provide or sell travel insurance.
7Intellectual Property
All content on milelekenya.com — text, images, and branding — is the property of Milele Kenya and may not be reproduced without written consent.
8Governing Law & Jurisdiction
These Terms & Conditions, and the assumption of risk and release above, are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising from these terms or your safari booking with Milele Kenya will be subject to the exclusive jurisdiction of the state or federal courts located in Maricopa County, Arizona.

Code of Conduct
To ensure a safe, respectful, and memorable safari experience — and to help preserve Kenya's natural and cultural heritage for generations to come — all travelers are expected to follow these principles.
1Follow Guides' Instructions
Always follow the directions of your guide or tour leader. Ignoring guidance may result in removal from the safari.
2Respect Wildlife
Maintain a safe distance from animals and never feed, chase, or harass them.
3Respect Local Communities
Treat local people, customs, and property with courtesy and respect. Ask permission before photographing individuals.
4Safety First
Avoid risky behavior, remain within designated areas, and use provided safety equipment.
5Responsible Travel
Minimize waste, follow park rules, and leave no trace of your visit.
6Group Harmony
Be considerate of fellow travelers. Disruptive or aggressive behavior may result in removal from the safari, with the traveler responsible for all costs incurred.
7Health & Insurance
Carry valid travel insurance covering medical emergencies, evacuation, and trip cancellations. Inform your guide of any medical conditions.
